Planning Your Estate

I can advise you on the best approach in discussing the planning of your estate — thoroughly analyze your estate with you and strategize the best means of transferring your assets pursuant to your wishes and desires; efforts made to minimize taxes, establishing guardianship for your children, supporting personal philanthropic causes, and protecting your loved ones. Draft a will that reflects your desires; establish a living trust, if beneficial to your estate. Drafting a Will that reflects your desires is crucial.

Extensive knowledge and experience about the New York probate court (Surrogate’s Courts) to guide you through the complex process of probating a will, and administering an estate. I assist executors and administrators in all steps of the process, including (but not limited to) the following:

  • Creating a plan of action to probate the Will expeditiously
  • Filing the Will with the New York Surrogate’s Court and filing all documents for probate
  • Obtaining Consents to Probate from all distributees and other necessary parties
  • Arranging for Citation to be issued by Court and served on all necessary parties
  • After Letters of Probate (Letters Testamentary) are issued to the Executor , arrange for closing bank accounts and opening estate accounts
  • Transferring assets from the deceased’s name to the estate

Note: If Probate is Not granted, or there is No Will, apply for Letters of Administration for an Administrator to be appointed — the duties and responsibilities of the Administrator are very similar to the duties and responsibilities of the executor.
